Iron Oak Property Solutions LLC ("Iron Oak," "we," "us," or "our") operates www.selltoironoak.com (the "Site"). Iron Oak is a Texas real estate investment company that buys properties directly from owners for cash and may assign or resell its contractual rights to investor buyers.
This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information obtained through the Site, related forms, communications, and services.
1. Scope
This Privacy Policy applies to personal information collected through:
- The Site and any pages hosted at or linked from selltoironoak.com;
- Property-submission forms, contact forms, investor forms, and other online forms;
- Telephone calls, text messages, and emails relating to Iron Oak's services;
- Communications concerning property evaluations, cash offers, inspections, closings, assignments, or investor transactions; and
- Other interactions that expressly link to this Privacy Policy.
This Policy does not apply to third-party websites, applications, platforms, title companies, lenders, contractors, investors, or other services that maintain their own privacy policies.
2. Information We Collect
The information we collect depends on how you interact with us.
A. Information You Provide Directly
We may collect:
- Name and contact information, including telephone number, email address, and mailing address;
- Property address, legal description, county, parcel or tax identification information, and ownership details;
- Information about the property's condition, occupancy, repairs, improvements, liens, mortgages, taxes, leases, and other relevant characteristics;
- Financial and transaction information reasonably relevant to evaluating a property or preparing an offer, such as payoff information, desired purchase price, outstanding liens, ownership interests, and closing information;
- Information about your relationship to the property, including whether you are an owner, trustee, personal representative, heir, landlord, agent, or other authorized representative;
- Message content, photographs, documents, recordings, and other materials submitted through forms or communications;
- Information supplied when you request a cash offer, schedule an inspection, communicate with our team, or participate in a closing or assignment transaction; and
- Preferences regarding communications, marketing, properties, or investment opportunities.
If you apply to rent or rent a property from Iron Oak, we may collect information such as your name, contact details, income and employment information, references, and screening information.
Please do not submit Social Security numbers, bank-account credentials, payment-card information, or other highly sensitive information through an unsecured form unless we specifically request it through an appropriate secure method.
B. Information Collected Automatically
When you visit or use the Site, we and our service providers may automatically collect:
- Internet Protocol ("IP") address;
- Browser type and version;
- Device type, operating system, and device identifiers;
- General location derived from IP address;
- Pages viewed, links clicked, forms viewed or submitted, and referring pages;
- Dates, times, and duration of visits;

3. How We Use Information
We may use personal information to:
- Respond to inquiries and requests;
- Evaluate properties and ownership information;
- Prepare, present, negotiate, and communicate cash offers;
- Contact property owners by telephone, text message, and email;
- Coordinate property inspections, appraisals, title work, escrow, and closings;
- Prepare, administer, assign, or complete purchase contracts and related transactions;
- Provide property and seller information to title companies, escrow companies, lenders, contractors, appraisers, and prospective assignee buyers or investors as reasonably necessary to evaluate, fund, close, assign, or complete a transaction;
- Use rental information to evaluate rental applications, manage tenancies, and comply with applicable law;
- Market Iron Oak's services, properties, investment opportunities, and related services;
- Maintain and manage our customer, seller, investor, and vendor relationships;
- Operate, maintain, personalize, secure, and improve the Site and our services;
- Analyze Site use, campaign performance, and business trends;
- Detect, investigate, prevent, and respond to fraud, security incidents, misuse, and unlawful activity;
- Comply with legal obligations, court orders, governmental requests, and regulatory requirements;
- Establish, exercise, or defend legal claims; and
- Accomplish other purposes disclosed when information is collected or otherwise permitted by law.
We may use deidentified, aggregated, or anonymized information for lawful business purposes. We will not attempt to reidentify information that we maintain in deidentified form except as permitted by law.
4. Telephone Calls, Text Messages, and Email Communications
By submitting your telephone number or email address, requesting information, requesting a cash offer, or otherwise providing contact information, you may receive communications from Iron Oak and its service providers regarding your inquiry, property, transaction, offer, inspection, closing, assignment, or related services.
Where required by applicable law, we will obtain appropriate consent before sending marketing text messages or placing certain marketing calls. Consent to receive marketing calls or text messages is not a condition of purchasing goods or services from Iron Oak.
Message and data rates may apply. Message frequency may vary.
You may opt out of marketing text messages by replying STOP. You may reply HELP for assistance. You may opt out of marketing emails by using the unsubscribe link in the email or by contacting us using the information in the "Contact Us" section. Opting out of marketing communications will not necessarily stop nonmarketing communications reasonably necessary to administer a transaction, respond to a request, or comply with law.
5. How We Share Information
We may disclose personal information to the following categories of recipients:
Prominent Notice — "Sale" of Personal Data Under the Texas Data Privacy and Security Act
The Texas Data Privacy and Security Act ("TDPSA") defines "sale of personal data" broadly to include exchanging personal data for monetary or other valuable consideration. In connection with our real estate-investment business, Iron Oak may share a seller's or prospective seller's personal information with prospective investors, assignees, or purchasers in connection with the possible assignment or sale of a purchase contract or property. For purposes of the TDPSA, Iron Oak treats this type of sharing as a sale of personal data in some circumstances. Texas consumers may opt out of the sale of their personal data using the privacy request process described in this Policy.
A. Service Providers
We may disclose information to companies that provide services for us, including:
- Website hosting and technology providers;
- Customer relationship management and database providers;
- Lead-generation and marketing platforms;
- Telephone, text-message, email, and communication providers;
- Analytics and advertising providers;
- Data-storage, security, and fraud-prevention providers;
- Document, electronic-signature, and workflow providers; and
- Professional advisers and administrative providers.
These providers may access or process information only as reasonably necessary to provide services to Iron Oak, subject to their agreements and applicable law.
B. Transaction Participants
We may share information with:
- Title and escrow companies;
- Closing agents and attorneys;
- Lenders and financing sources;
- Contractors, inspectors, appraisers, and other property professionals;
- If Iron Oak renovates and resells a property, contractors, vendors, and real estate professionals involved in the renovation or resale;
- Insurance providers;
- Governmental authorities and recording offices; and
- Other parties involved in evaluating, documenting, funding, or closing a transaction.
C. Prospective Buyers, Investors, and Assignees
Iron Oak may put a property under a purchase contract and later assign its contractual rights to an investor or other buyer. In connection with a potential or completed assignment, resale, or purchase transaction, Iron Oak may share property information and seller information with prospective buyers, investors, assignees, funding sources, title companies, and other transaction participants.
This information may include the seller's name and contact information, property address, ownership information, property condition, photographs, documents, requested terms, title information, and other information reasonably necessary to evaluate or complete the transaction.
Iron Oak may also disclose that it is the contracting party or that it intends to assign its contractual rights. Prospective buyers and assignees may contact Iron Oak, the seller, the title company, or other transaction participants as necessary to evaluate or complete the transaction.
D. Legal and Business Transfers
We may disclose personal information:
- To comply with applicable law, subpoena, court order, legal process, or governmental request;
- To protect the rights, property, safety, or security of Iron Oak, our users, or others;
- To investigate fraud, security incidents, or unlawful conduct;
- In connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or other business transfer; or
- With your direction or consent.
We do not sell personal information in exchange for money as a primary business purpose. However, certain disclosures may constitute a "sale" or "sharing" of personal information under California law, particularly disclosures to advertising partners or prospective buyers and assignees in connection with a transaction. The California-specific section below explains applicable rights and choices.
6. Legal Bases and Consent
Although United States privacy laws generally do not require a formal "legal basis" framework for all processing, we process personal information based on one or more of the following grounds:
- Your consent or direction;
- The need to respond to your request or perform a contract;
- Our legitimate business purposes, including evaluating properties, making offers, completing transactions, operating the Site, improving services, preventing fraud, and communicating with you;
- Compliance with legal obligations; and
- Protection of our rights, property, users, and business operations.
Where we rely on consent, you may withdraw consent as permitted by law. Withdrawal will not affect processing already completed or processing based on another lawful basis.
7. Cookies and Tracking Technologies
We and our service providers may use cookies, pixels, tags, web beacons, software development kits, local storage, and similar technologies to:
- Keep the Site functioning;
- Remember preferences;
- Understand Site traffic and usage;
- Measure advertising and marketing performance;

8. Do Not Track and Global Privacy Control
Some browsers offer a "Do Not Track" ("DNT") setting. Because there is no universally accepted industry standard for responding to DNT signals, the Site may not respond to all DNT signals unless required by applicable law.
Where required by applicable law and technically supported, we will process recognized universal opt-out preference signals, including the Global Privacy Control ("GPC"), as a request to opt out of the sale of personal data, targeted advertising, and other applicable sale, sharing, or targeted-advertising activities. The effect of a GPC signal may depend on the browser, device, account, and legal requirements applicable to the individual.

9. Data Retention
We retain personal information for as long as reasonably necessary to:
- Provide requested services;
- Evaluate, document, administer, and complete transactions;
- Maintain business and transaction records;
- Comply with legal, accounting, tax, regulatory, insurance, and reporting obligations;
- Resolve disputes and enforce agreements;
- Detect and prevent fraud and security incidents; and
- Fulfill the purposes described in this Policy.
Retention periods vary based on the nature and sensitivity of the information, the purpose for which it was collected, the existence of a transaction, applicable legal requirements, and legitimate business needs, and the criteria used to determine the retention period for each category of personal data (including that rental application data is retained for the period necessary to evaluate the application and to comply with fair housing and landlord-tenant recordkeeping requirements).
When information is no longer reasonably necessary, we may delete it, deidentify it, or securely dispose of it, subject to legal and operational limitations.
10. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or destruction.
No method of transmitting or storing information is completely secure. We cannot guarantee the absolute security of personal information. You should use caution when submitting information online and should not send sensitive information through an unsecured channel.
If we determine that a security incident requires notice under applicable law, we will provide notice as required.
11. Data Breach Notification (Texas)
If a breach of system security occurs involving personal information as defined under Texas law, Iron Oak will notify affected Texas residents as required by Tex. Bus. & Com. Code § 521.053, in the time, manner, and content required by that statute. Notice may be provided by written notice, electronic notice, or substitute notice where the statute permits.
12. Children's Privacy
The Site is not directed to children under 18 years of age. We do not knowingly collect personal information from children under 18.
If you believe a child has provided personal information to us, contact us using the information below. If we learn that we collected personal information from a child in circumstances requiring deletion, we will take reasonable steps to delete it.
13. Third-Party Links and Services
The Site may contain links to third-party websites, services, social-media platforms, title companies, investor resources, or other destinations. We do not control and are not responsible for the privacy, security, or content practices of third parties.
Your interactions with third parties are governed by their privacy policies and terms. We encourage you to review those policies before submitting personal information.
14. Your Choices
Depending on applicable law, you may have the following choices:
- Decline to provide optional information;
- Correct inaccurate information;
- Request access to information we maintain about you;
- Request deletion of information, subject to legal exceptions;
- Request a copy of information in a portable format;

15. Texas Residents — Texas Data Privacy and Security Act (Tex. Bus. & Com. Code Ch. 541)
To the extent the Texas Data Privacy and Security Act ("TDPSA"), Tex. Bus. & Com. Code Ch. 541, applies to Iron Oak, Iron Oak processes personal data in accordance with this section. The TDPSA exempts small businesses as defined by the U.S. Small Business Administration. Iron Oak provides these disclosures and honors these rights in addition to any obligation the TDPSA imposes, and nothing in this Policy is an admission that the TDPSA applies.
A. Categories of Personal Data We Process
Depending on your interactions with us, we may process the following categories of personal data:
- Identifiers and contact information (such as name, mailing address, email address, telephone number, and online identifiers);
- Property and transaction information (such as property address, ownership information, property condition, and transaction communications);
- Internet or other electronic network activity information (such as IP address, device information, pages viewed, and interaction data);
- General location information derived from IP address;
- Communications content and related information (such as messages and documents you submit);
- Rental application and tenancy information (such as income and employment information, references, and screening information); and
- Inferences derived from the information above.
B. Purposes of Processing
We process personal data for the purposes described in this Privacy Policy, including:
- Responding to inquiries and requests;
- Evaluating properties and ownership information and making and communicating offers;
- Administering, assigning, and completing transactions and related communications;
- Evaluating rental applications, managing tenancies, and complying with applicable law;
- Operating, maintaining, securing, and improving the Site and our services;
- Marketing our services and measuring campaign performance;
- Detecting, investigating, preventing, and responding to fraud, security incidents, misuse, and unlawful activity; and
- Complying with legal obligations and establishing, exercising, or defending legal claims.

- Transaction participants (such as title and escrow companies, closing agents and attorneys, lenders, contractors, inspectors, appraisers, insurance providers, and governmental authorities);
- Prospective buyers, investors, and assignees (in connection with an assignment, resale, or purchase transaction); and
- Contractors, vendors, and real estate professionals involved in renovation or resale activities where applicable.
D. Texas Consumer Rights
Subject to applicable law and exceptions, Texas consumers have the right to:
- Confirm and access: Confirm whether a controller is processing personal data and access the personal data;
- Correct: Correct inaccuracies in personal data;
- Delete: Delete personal data provided by or obtained about the consumer;
- Portability: Obtain a portable copy of the consumer's personal data; and
- Opt out: Opt out of (a) the sale of personal data, (b) targeted advertising, and (c) profiling in furtherance of a decision that produces a legal or similarly significant effect.
E. How to Exercise Texas Rights; Timing of Our Response
To exercise your Texas privacy rights, you may submit a request using the methods in the "How Texas Residents May Submit a Request" section below. To the extent the TDPSA applies to Iron Oak, we will respond to a request within 45 days of receipt. We may extend the response period once by an additional 45 days when reasonably necessary, and we will notify you of the extension.
F. Appeal Process
If Iron Oak declines to act on your request, to the extent the TDPSA applies to Iron Oak, we will notify you within 45 days. You may appeal our decision by contacting us using the same methods described below and stating that you are submitting an appeal. To the extent the TDPSA applies to Iron Oak, we will respond to an appeal within 45 days of receipt with a written explanation of the reasons for the decision. If your appeal is denied, you may contact the Texas Attorney General to submit a complaint.
G. Sensitive Data and Consent
Iron Oak may collect information that constitutes sensitive data in limited circumstances, including financial account information and precise geolocation. To the extent the TDPSA requires consent before processing sensitive data, Iron Oak will obtain that consent before processing it, or will not process it. Iron Oak does not knowingly collect personal data from children under 18 years of age. Iron Oak does not knowingly sell or process the personal data of a known child without complying with applicable law.

We may need to verify your identity before completing a request. We may ask for information reasonably necessary to authenticate the request, but we will not require you to create an account solely to submit a request.
You may use an authorized agent where permitted by law. We may require proof of the agent's authority and may independently verify your identity.
To the extent the TDPSA applies to Iron Oak, we will respond to a request within 45 days of receipt. We may extend the response period once by an additional 45 days when reasonably necessary, and we will notify you of the extension. If we deny a request in whole or in part, we will explain the basis for the denial and provide appeal instructions when required.
The TDPSA is enforced by the Texas Attorney General and does not provide a private right of action. Texas consumers may submit a complaint to the Texas Attorney General's office if they believe their rights have been violated.
16. California Residents — CCPA and CPRA Rights
This section applies to California residents to the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies to Iron Oak's processing of their personal information.
A. Categories of Personal Information Collected
During the preceding 12 months, Iron Oak may have collected the following categories of personal information:
- Identifiers, such as name, postal address, email address, telephone number, online identifiers, and IP address;
- Customer records information, such as contact details, property information, and transaction-related information;
- Commercial information, such as property characteristics, transaction interests, offer information, and purchase or sale history;
- Internet or other electronic network activity, such as browsing history, pages viewed, interactions, and device information;
- Geolocation information, such as general location derived from an IP address;
- Audio or electronic information, such as recorded communications where permitted and appropriately disclosed;
- Inferences drawn from the information above, such as property interests or preferences; and
- Other information that identifies or relates to a California resident or household.
We may collect these categories from the consumer, the consumer's device, public records, service providers, transaction participants, marketing providers, and other sources described in this Policy.
B. Business and Commercial Purposes
We may use the categories above for the purposes described in the "How We Use Information" section, including property evaluation, communications, marketing, transaction administration, assignment or resale coordination, analytics, security, legal compliance, and service improvement.
C. Categories of Recipients
We may disclose the categories of personal information above to the categories of recipients described in the "How We Share Information" section, including service providers, CRM and marketing platforms, analytics and advertising providers, title and escrow companies, lenders, contractors, appraisers, professional advisers, governmental authorities, prospective buyers, investors, and assignee buyers.
D. Sale or Sharing of Personal Information
California law broadly defines "sale" and "sharing." Depending on the circumstances, Iron Oak may "sell" or "share" personal information under those definitions by:
- Providing property and seller information to prospective assignee buyers, investors, or other transaction participants in connection with a potential or completed assignment, resale, or purchase transaction;
- Providing identifiers, Internet activity information, or inferred preferences to advertising, analytics, or marketing providers; or
- Using or disclosing information for cross-context behavioral advertising or similar marketing activities.
Iron Oak does not sell personal information for money as its primary business purpose. However, California residents may opt out of any activity that qualifies as a sale or sharing under California law.
To submit an opt-out request, use the "Do Not Sell or Share My Personal Information" link on the Site, when available, or contact us using the methods in the "Contact Us" section. We will honor valid Global Privacy Control signals as required by applicable law.
E. California Consumer Rights
Subject to applicable exceptions, California residents may have the right to:
- Know or access: Request information about the categories and specific pieces of personal information collected, the sources, purposes, and categories of recipients;
- Delete: Request deletion of personal information collected from the consumer;
- Correct: Request correction of inaccurate personal information;
- Opt out: Opt out of the sale or sharing of personal information;
- Limit: Limit the use or disclosure of sensitive personal information where the law grants that right;
- Non-discrimination: Receive equal service and pricing notwithstanding the exercise of privacy rights; and
- Opt out of profiling: Opt out of certain profiling activities that produce legal or similarly significant effects, where applicable.
We will not discriminate against you for exercising rights provided by law. We may, however, provide different services or terms when reasonably related to the value of information, as permitted by law.

We may need to verify your identity before responding. The verification process may depend on the nature and sensitivity of the request. You may use an authorized agent where permitted by law. We may require proof of authorization and may independently verify your identity.
We generally respond to verifiable requests within the time required by applicable law. If additional time is legally permitted and reasonably necessary, we will notify you of the extension. If we deny a request, we will explain the basis for the denial and provide any appeal rights required by law.
G. Sensitive Personal Information
We do not intentionally request sensitive personal information through ordinary Site forms unless reasonably necessary for a transaction or permitted business purpose. If we collect sensitive personal information, we will use and disclose it only as permitted by applicable law and this Policy.
17. Rental Applications and Tenant Screening (FCRA)
If you apply to rent a property from Iron Oak, Iron Oak may obtain a consumer report or background screening report about you from a consumer reporting agency. The report is used solely for evaluating your rental application and for permissible purposes under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). If Iron Oak takes adverse action based in whole or in part on the report, Iron Oak will provide you with an adverse action notice including the name and contact information of the consumer reporting agency, a statement that the agency did not make the decision, and notice of your right to obtain a free copy of the report and to dispute its accuracy.
18. Updating or Deleting Your Information
You may request that we update or delete information by contacting us using the methods listed below. We may retain certain information when necessary to:
- Complete a transaction;
- Maintain business, tax, legal, accounting, or title records;
- Exercise or defend legal claims;
- Detect or prevent fraud;
- Comply with legal obligations; or
- Fulfill another lawful purpose.
Deleting or restricting information may affect our ability to communicate with you, evaluate a property, make an offer, or complete a transaction.
19. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will post the updated Policy on the Site and revise the "Last Updated" date.
If a change materially affects how we use or disclose personal information, we may provide additional notice through the Site, email, text message, or another legally permitted method. Your continued use of the Site after the updated Policy becomes effective means that you acknowledge the updated Policy, subject to applicable law.
